Terms of Use

Last updated

The rules for using Nearwire, from your first API key to a paid subscription.

01Agreement and eligibility

These Terms of Use govern your access to the Nearwire website, dashboard, and API (the “Service”). By using the Service, you agree to these terms. You must be at least 18 years old and able to enter into a binding agreement. If you use the Service for an organization, you confirm that you have authority to accept these terms on its behalf. If you do not agree, do not use the Service.

02Accounts and API keys

Provide accurate account information and keep your password and API keys secure. You are responsible for activity under your account and for the applications you connect to the Service. Do not publish secret API keys or share your account credentials. If you suspect unauthorized access, revoke affected keys in the dashboard and notify the Nearwire operator promptly.

03Acceptable use

You may use the Service in your applications, subject to your plan limits and these terms. You must not:

  • Use the Service for unlawful activity or violate another person’s privacy or intellectual property rights.
  • Bypass usage limits, authentication, or other access controls, including by creating accounts to evade quotas.
  • Interfere with the Service, introduce malicious code, or attempt to access another user’s account or data.
  • Misrepresent your identity or submit information you do not have the right to process.

04Plans, billing, and cancellation

Free and paid plans have usage limits shown on the pricing page and in your dashboard. Paid subscriptions are processed through Stripe and renew automatically at the interval and price shown at checkout until canceled. You authorize recurring charges and any applicable taxes disclosed at checkout.

You can manage or cancel a subscription through the billing portal linked from your dashboard. The portal shows when cancellation takes effect. Cancellation stops future renewals and does not automatically refund prior charges. Refunds are provided where required by law or expressly offered at purchase. Any price changes for an existing subscription will be communicated before they take effect, with an opportunity to cancel.

05News content and ownership

Nearwire indexes headlines, summaries, and links from third-party feeds. That content belongs to its respective owners. Access through the API does not transfer ownership or grant a license to republish content beyond permissions granted by the publisher or applicable law. You are responsible for checking those permissions and preserving required attribution.

Nearwire retains its rights in the Service’s software, branding, and design. You retain any rights you have in your submitted queries and other inputs, and authorize us to process them as needed to provide the Service, as described in our Privacy Policy.

06Availability and search results

The Service and search results are provided “as is” and “as available,” to the extent permitted by law. We do not guarantee uninterrupted access, complete news coverage, or the accuracy, timeliness, or relevance of results. Similarity scores indicate a computational match, not verification of a story. Check original sources before relying on results. We may maintain, update, or discontinue features and will give reasonable notice of material changes to paid services where practicable.

07Limits of liability

To the extent permitted by law, Nearwire is not liable for indirect, incidental, special, or consequential losses, including lost profits or data, arising from your use of the Service. Our total liability for claims relating to the Service is limited to the greater of US $100 or the amount you paid for the Service in the 12 months before the event giving rise to the claim. These limits do not exclude liability that cannot legally be excluded or restrict any mandatory consumer rights you may have.

08Suspension and termination

We may suspend or terminate access for violations of these terms, nonpayment, or activity that threatens the security or operation of the Service. Where practicable, we will provide notice and an opportunity to resolve the issue. You may stop using the Service at any time, cancel a paid subscription through the billing portal, or delete your account on the Account page. Account deletion cancels paid subscriptions immediately and does not automatically refund prior charges. Terms concerning ownership, outstanding payment obligations, and liability continue to apply after access ends.

09Changes to these terms

We may update these terms and will revise the date above when we do. Material changes will be communicated through the Service or your account email before taking effect where required by law. Continued use after updated terms take effect constitutes acceptance to the extent permitted by law. If you do not accept the changes, stop using the Service and cancel any subscription.
